TERMS OF SERVICE

By choosing to commission me, you acknowledge that you have read and agree to my terms of service, set and explained here in this module.

  • I reserve the right to decline any commission for any reason including personal or professional.
    1. Please take my style into consideration when thinking about a commission. If I feel that I cannot effectively illustrate your commission idea, I will decline.
    2. I do NOT draw any content that has political connotations, has offensive ideologies, hateful speech, obscenities, or otherwise discriminatory to any groups or parties in any way. Should you request a commission of this kind, you will be declined and blacklisted.
  • All work commissioned is to be personal or private ONLY. Commercial commissions may be discussed.
    1. Personal usage is defined as cropping or resizing for icons, wallpapers, or character profile graphics ONLY. Edits such as drawing over, tracing, or manipulating the artwork in any capacity (including color changing/editing) is strictly prohibited.
    2. Commissioned artworks of private or personal characters will never be used in for-profit promotional materials including merchandise, prints, and zines without the express permission of the commissioner. Commissions of characters from other intellectual properties (i.e: fanart) are exempt from this rule.
  • I reserve the right to use any of my artwork for my own promotional materials.
    1. Promotional materials are defined as usage in my commission gallery, as examples for future commissions, or in non-profit promotional materials.
    2. If for any reason your commission needs to be private, please let me know so that I can refrain from posting it on my website or social media galleries.
  • Redistribution of my work through the use and/or creation of NFTs, crypto, block chain, AI, and/or other equivalent medium is strictly prohibited.
    1. I will never support NFTs/crypto/block chain/etc.
    2. Use of my art for AI modules/learning programs is strictly prohibited.

If your commission slot is not confirmed or the invoice has yet to be paid for 7 days/1 week, your commission spot will be forfeit. This is to ensure that my work list moves as smoothly as possible between batch periods. Thank you for understanding.
  1. Payment is taken in full, up-front before work on a commission is started unless otherwise previously negotiated. Payments must be made through PayPal, Ko-fi, or Commiss.io, in USD. No bank transfers or e-checks will be accepted. Holds can be negotiated if the total payment amount exceeds 150$. Any payments done incorrectly or in the wrong currency will promptly be refunded.
  2. Payment plans can be negotiated if the total exceeds 250$. At least a 25% down payment is required, and is non-refundable under any circumstances. In the case of a payment plan, the final, un-watermarked piece will not be delivered until the final payment is complete.
  3. Refunds are allowed only if there is a valid reason and a discussion about the refund prior. A refund CANNOT be processed once the piece has been finished by the artist and presented to the client. If a charge-back is attempted, you will be blacklisted and any work done up until that point will be destroyed immediately.

- Please fill out the forms provided to the best of your ability. If there is anything important that I need to know about the character, include it in the references/comment section. I will make edits to works that have inaccuracies due to my mistake but if they are not a mistake on my part and a result of a failed communication, further edits will incur and additional charge.
  1. Edits within the working process of a commission are allowed within reason. For minor edits, I will allow up to two edit requests for free. The third edit--whether its the commissioner's preference or my mistake--will incur a fee of 20% of the commission cost. If you request a pose change past the line-art stage, there will be a 50% fee of the total commission cost incurred.
  2. If you have a specific or difficult pose/idea request, please provide as many references as you can, even if it's just some stick figure drawing! Something is better than nothing.
  3. I will not use literary descriptions of any kind. All references must be visual.

- I like to work on commissions in one sitting for as long as I can (or until they are finished). For this reason, progress shots can be requested at any time but please be advised that doing so hinders my work flow and may slow the delivery of your commission considerably.
  1. If you have a time-sensitive commission you would like to inquire about, please let me know beforehand. I will NOT take deadlines after a commission is accepted!

- Any further details of batch commissions (commissions opened through journal or other social media) or YCH commissions (pre-sketched works) will apply additionally on top of the terms of service stated here.

Failure to comply with these terms will result in a refusal of service and blacklisting.
